What is the legal basis for private parking fees?

We manage private parking areas. Private property rights and the Contracts Act apply here, unlike public parking areas, which are regulated by the Traffic Act. An owner of a parking area can, under general property law, set rules for use of the parking area. The owner may also choose to let a private parking company such as OPARKO manage the area and supervise compliance with the rules. Signs are erected so that the conditions are visible to everyone who drives into the area. It is your responsibility as a driver to read and familiarise yourself with the conditions before parking. If you do not comply with the applicable conditions, you may be charged a parking fee, regardless of whether you have seen the signs. The legal basis is Contracts Act (Aftaleloven) § 1.

What is Order 2025-06-27 No. 970?

On 1 July 2025, a new executive order came into force that changes the rules for private parking enforcement. Under the new regulations, it is no longer permitted to issue parking fees solely based on camera surveillance (e.g. via automatic number plate recognition, ANPR). Please note that all fees issued before 1 July 2025 were made in accordance with the legislation in force at the time and will therefore be upheld.

Why do we issue parking fees?

If a vehicle is parked irregularly in violation of the applicable terms on a private parking area that OPARKO manages, a parking fee is issued. The parking fee is established under private law rules for parking.

I was only parked there for a short time. Does that matter?

In areas where both stopping and parking are prohibited, the observation time is 0 minutes. In areas where only parking is prohibited, standard observation rules apply. The rules for each area are displayed on the signage at the entrance.

Is a private parking fee the same as a fine from the police?

No. A parking fee from OPARKO is a private claim based on the agreement you enter into when you park on a privately managed area. It is not a public fine issued by the police or municipality under the Traffic Act, and it does not result in penalty points on your licence or a criminal record. It is, however, a binding payment obligation under private law.

I wasn't the one driving. Do I still have to pay?

The parking fee concerns the vehicle and is sent to the registered owner/keeper, as this is the information available to us. As the registered owner, you are expected either to settle the fee or, if someone else was driving, to pass on the information needed for us to pursue the correct person. You can provide these details through the case portal.
